1.) These general terms and conditions apply to all contracts concluded with EGON Hotel GmbH, Königstrasse 4, 22767 Hamburg, provided they meet the criteria of the provisions governing general terms and conditions. They may be replaced by terms negotiated on a case-by-case basis. By this fact alone, they are deemed to have been adequately brought to the attention of the customers, the parties to the rental agreement and any third parties.
2.) Concluding the guest accommodation contract (rental agreement) obliges the contracting parties to perform the contract, regardless of the period for which the contract has been concluded. The contract cannot be terminated unilaterally. Services that are not guaranteed by a written assumption of costs by the customer or by the presentation of a valid credit card number are, without exception, held available until 4:00 pm on the day of arrival; thereafter, for non-guaranteed services, the hotel may dispose of them as it sees fit, in particular by re-letting the hotel rooms. Hotel rooms are available to the guest from 3:00 pm on the day of arrival and until 11:00 am on the day of departure. In the event that guests behave conspicuously during their stay due to the consumption of alcohol or other drugs and thereby disturb the general peace and the hotel's operating procedures, or cause a nuisance to other guests or hotel staff, the hotel reserves the right to terminate the guest accommodation contract unilaterally and to exercise its right to refuse entry. Should there be any unusual soiling that goes beyond a normal degree, or even damage to the hotel inventory caused by the guest, the guest is liable for the cost of replacement or for any necessary deep cleaning.
3.) Option dates are binding for both contracting parties. The hotel reserves the right to let the reserved rooms and function rooms elsewhere once the option dates have expired.
4.) Services and rates are set by the management and may be modified after the contract has been concluded if the period between the conclusion of the contract and the provision of the service is more than 120 days.
5.) The customer or visitor bears sole liability for items or materials they have left in the generally accessible areas of the hotel. Within the room, liability can only be assumed for personal items of the customer that they actually need while using the room. Liability here must be limited to the permissible extent. Valuables such as jewellery, fur coats and money must be deposited at reception, whereby a separate safekeeping agreement is to be concluded only with a person authorised to do so.
6.) If the person placing the order is not also the organiser, or places the order at the expense of another party, both are liable as joint and several debtors.
7.) As a general rule, payment is agreed to be made before the service is used.
8.) In the following cases, the customer shall be charged for the contractual service ordered but not rendered, even if it was only partially cancelled. The service may accordingly include the guests' accommodation, the rental of conference rooms and the catering.
The cancellation charges are reduced by the amount of accommodation revenue that can be achieved by re-letting the cancelled rooms for the date ordered.
9.) Invoices are payable within 14 days of receipt. After this period has elapsed, the customer's account will be charged default interest at a rate of 1.5 % per month.
10.) Should the organiser be a political association, the validity of the contract additionally requires the approval of the hotel's management. If the organiser fails to disclose to EGON Hotel GmbH that it is a political association, the hotel is entitled to terminate the contract and to charge the corresponding provisioning costs.
11.) EGON Hotel GmbH may, without giving reasons, make the acceptance of any order, any reservation or any other service to be performed or continued conditional on the full or partial settlement of the amounts owed to it, in the form of a deposit, an instalment or full payment, even where these are to be rendered in advance.
12.) In the public areas, the consumption of food and drink brought in from elsewhere is prohibited.
13.) If EGON Hotel GmbH has reasonable grounds to believe that an event threatens to jeopardise the smooth running of the business, the safety or the reputation of the hotel, as well as in cases of force majeure, it may cancel any event or booking.
14.) No verbal or written collateral agreements have been made. Amendments or additions must be made in writing to be legally valid.
15.) The place of jurisdiction is Hamburg.
